The Romanian Civil Aeronautical Authority has the legal status of autonomous overhead of national public interest, operating under the authority of the Ministry of Transport and Infrastructure as a central public authority, being applicable the provisions of Law no. 544/2001 on free access to information of public interest, according to which it is obliged to ensure citizens' access to information of public interest ex officio or upon request, through the person designated for this purpose.

Any natural or legal person has the right to request and obtain, freely and unrestricted, from the Romanian Civil Aeronautical Authority, in compliance with the legal provisions, the information of public interest resulting from the activities of the Romanian Civil Aeronautical Authority.

The legal reference provisions that allow the interested person access to information of public interest are the following:
- Universal Declaration of Human Rights - art.19;
- Romanian Constitution - art. 31;
- Law no. 544/2001 on free access to information of public interest
- The methodological norm for the application of Law no. 544/2001 on free access to information of public interest;
- Law no. 677/2001 on the protection of personal data and the free movement of such data;
- Law no. 182/2002 on the protection of classified information
- Ordinance no. 27/2002 regarding the regulation of the activity of solving the petitions

The access to the information of public interest communicated ex officio is made:
- By publishing on its own website;
- By consultation, at the AACR headquarters, in the information-documentation points

In order to facilitate the drafting of the application and the administrative complaint, AACR makes available to the interested person Forms type 1, 2, drawn up in accordance with the provisions of the Methodological Norm for the application of Law 544/2001 on free access to information of public interest

The request for information of public interest, other than those provided to be communicated ex officio, will be addressed to the Romanian Civil Aeronautical Authority, under the conditions of art. 6 of Law no. 544/2001.
Natural or legal persons wishing to request RA-AACR information of public interest concerning the areas of activity under the responsibility of RA-AACR must address in writing to the Director-General of RA-AACR / Spokesperson of RA-AACR (PC) .

In order to obtain information / copies of documents of public interest, the applicant completes Form 1 of this guide, provided by the RA-AACR registry or downloaded from the RA-AACR website (www.caa.ro).

The application can be submitted by the applicant to the RA-AACR registry or it can be sent by e-mail to the General Director of RA-AACR or to the attention of the PC at the e-mail addresses: dir.gen@caa.ro and / or información.publice @ caa.ro.

The services of copying the requested documents in written format are charged according to the fees charged by RA-AACR. (Www.caa.ro).

If the applicant is dissatisfied with the response received from the RA-AACR, he / she may submit a completed form on Form 2 of this Guide, provided by the RA-AACR Registry or downloaded from the RA-AACR website (www.caa. en).

If the applicant has not received a response within the legal deadline, the applicant may submit a completed form on Form 3 of this guide, provided by the RA-AACR Registry or downloaded from the RA-AACR website (www.caa.ro). If the space provided on Forms 1, 2, 3 is not sufficient, the additional page, respectively Form 4 of this Guide, will be used.

The administrative complaint against the explicit or tacit refusal of the employee designated by RA-AACR for the application of the legal provisions regarding the provision of information of public interest (RA-AACR Spokesperson) shall be submitted to the AACR headquarters within 30 days from the acknowledgment, by the injured person, according to Form 2.

If the complaint proves to be well-founded, the Romanian Civil Aviation Authority will send, within 15 days from the submission of the administrative complaint, the answer of the applicant who is considered harmed using Form 5 to this Guide. This reply shall contain the information of public interest initially requested and shall also mention the disciplinary sanctions applied in the case of the guilty official, in accordance with the law.

The applicant who, after receiving the answer to the administrative complaint, is still considered injured in his rights provided by law, may file a complaint to the administrative contentious section of the court, within 30 days from the expiration of the terms provided in art. 7 of Law no. 544/2001.

Information of public interest may also be requested and communicated in electronic format. In case of alteration of the information transmitted in electronic format, for reasons independent of its will, the Romanian Civil Aeronautical Authority does not assume responsibility

In formulating the answers to the requests regarding the provision of information of public interest, the Romanian Civil Aeronautical Authority uses Form 6 to this Guide.

The provision of information of public interest to the media takes place with the approval of the Ministry of Transport and Infrastructure.
