The subsequent acts of Law no. 362/2018 concerning measures for a high common level of security of networks and information systems (NIS Law), have been published as follows:
- HG no. 963 of 5 November 2020 regarding the approval of the List of essential services - Monitorul Oficial al României, Partea I, nr. 1086 din 16 noiembrie 2020.
- HG no. 976 of 12 November 2020 regarding the approval of the threshold values for establishing the significant disruptive effect of incidents on the networks and computer systems of essential services operators - Monitorul Oficial al României, partea I, nr. 1089 din 17 noiembrie 2020.
The civil aviation entities established in Romania have the obligation to identify and notify CERT-RO / National Competent Authority for Security of Networks and Information Systems (ANSRSI), regarding their inclusion in the List of essential services operators and civil aviation entities, according to the above-mentioned Government Decisions (HGs).
The deadline for identification and notification of CERT-RO / ANSRSI is 17 December 2020. After this date, the notification obligation is not fulfilled, constitutes a contravention and is sanctioned with a fine according to art. 39 of Law no. 362/2018.
