Starting with September 11, 2020, the Romanian Civil Aeronautical Authority (AACR) is designated as the market surveillance authority for the products that fall under the incidence of chap. II of the Delegated Regulation (EU) 2019/945, in accordance with the provisions of GD no. Amending Regulation (EC) No 643/2020 laying down measures for the implementation of Commission Delegated Regulation (EU) 2019/945 on unmanned aerial vehicle systems and unmanned aerial vehicle system operators in third countries and Implementing Regulation (EU) 2019/947 on the rules and procedures for the operation of unmanned aircraft on board.
Thus, starting with September 11, 2020, in the exercise of the attributions of market surveillance authority, AACR may order measures regarding the restriction or prohibition of the introduction and / or making available on the Romanian market of a product from the category of unmanned aircraft operating in the “open” category (drones / UAS / aeromodels) or for withdrawing or recalling it from the market.
In accordance with Art. 6 of GD no. 643/2020, starting with September 11, 2020, the producers based in Romania, as well as the importers of the products from the category of unmanned aircraft on board destined to operate in the “open” category (drones / UAS / aeromodels) have the obligation to communicate to AACR the addresses and the contact details of the distributors to whom they supplied products for sale in Romania. Also, distributors selling products of the same category on the territory of Romania, including through online sales or other means of distance selling, are obliged to communicate to AACR the contact details and addresses of the producers or, as the case may be, of the importers who supplied them. products.
According to GD 643/2020, non-compliance with the conditions for placing on the market of products from the category of unmanned aircraft on board (drones / UAS / aeromodels) constitute contraventions and is sanctioned with fines between 2,000 and 20,000 lei, as the case may be.
