Deadlines for communicating the information of public interest

Written communication

According to the provisions of Law no. 544/2001 on free access to information of public interest, as subsequently amended and supplemented, the deadlines for the written communication of a reply to applicants for information of public interest are as follows:  

  1. a) 10 days for the communication of the requested information of public interest, if it has been identified within this term;
  2. b) 10 days for announcing the applicant that the term provided for under the letter a) was not sufficient to identify the requested information;
  3. c) 30 days for the communication of the information of public interest identified beyond the term provided for under the letter a);
  4. d) 5 days for the transmission of the refusal to communicate the requested information and the motivation of the refusal.

Verbal communication

According to the provisions of Law no. 544/2001 on free access to information of public interest, with subsequent amendments and completions, the deadlines for verbal communication of a response to applicants for information of public interest are the following:

  1. a) the officials within the information and public relations departments have the obligation to specify the conditions and forms in which the access to the information of public interest takes place and may provide the requested information on the spot;
  2. b) if the requested information is not available on the spot, the person is instructed to request the information of public interest in writing, and the request will be resolved within the deadlines provided for above, under "Written communication" of the requested information of public interest;
  3. c) the information of public interest requested verbally by the mass media will be communicated, as a rule, immediately or within 24 hours at most.

 

Additional details

The deadlines provided above are calculated from the date when the application was registered, under the conditions of paragraph (4) of Article 20 of Law no. 544/2001 on free access to information of public interest, with subsequent amendments and completions.

The day from which the term starts to run and the day when it expires are not included in the calculation of deadlines. When the last day of a term i a non-working day, the term extends to the first working day that follows.
