In accordance with the provisions of art. 12 of the Romanian Air Code of 2020, in peacetime, the Ministry of Transport, Infrastructure and Communications and the Ministry of National Defense organize the national airspace and establish, as the case may be, the principles, rules and limitations of its use.

Establishment and modification of segregated, restricted, reserved airspace or other airspace structures
The manner of classification and organization of the national airspace, as well as the establishment of segregated, restricted, reserved airspace or other space structures are set by joint order of the Minister of Transport and the Minister of National Defense: Order of the Minister of Transport no. 1328 / M128 / 2013 for the approval of the Romanian civil-military aeronautical Regulation on airspace management and application of the concept of flexible use of airspace in the flight information region Bucharest and for establishing the way of classification and organization of airspace from the Bucharest flight information region, RACMR MSA-UFSA, edition 1/2013.
 
Use of segregated, restricted, reserved airspace or other airspace structures.
Requests for the use of segregated, restricted, reserved airspace or other airspace structures shall be submitted in accordance with the provisions of the Romanian Civil-Military Aviation Regulation on airspace management and the application of the concept of flexible use of airspace in the Bucharest flight information region, RACMR MSA-UFSA, edition 1/2013 to AMC Romania:
