We inform you that, on 24.04.2014, Regulation (EU) no. 379/2014 of the Commission amending Regulation (EU) no. Amending Regulation (EC) No 965/2012 laying down technical requirements and administrative procedures for air operations under Regulation (EC) No Regulation (EC) No 216/2008 of the European Parliament and of the Council introducing a set of rules for specialized operations with airplanes, helicopters, balloons and gliders, taking into account the specific aspects of these operations and the associated risk (SPO Subpart - Specialized Operations). This regulation entered into force on 27.04.2014 and will be applicable starting with 01.07.2014.
In accordance with the provisions of Article 10, paragraphs 4 and 5 (b) of Regulation (EU) no. 965/2012, introduced by Article 1, par. 7 of Regulation (EU) no. 379/2014, Member States may choose not to apply the provisions of Annexes II, III, VII and VIII to specialized operations and the provisions of Annexes II, III and IV to CAT operations with balloons and gliders until 21 April 2017.
As regards Article 10 (5) (a) of Regulation (EU) No 1095/2010, 965/2012, introduced by Article 1, para. 7 of Regulation (EU) no. Commission Regulation (EC) No 379/2014 on the possibility for Romania not to apply the provisions of Annexes II, III and IV in the case of CAT operations with a point of departure and a point of arrival at the same aerodrome or place of operation performed with performance class B aircraft; or helicopters other than complex ones until 21 April 2017, given the advanced stage of the implementation process of Regulation (EU) no. 965/2012 both within the competent authority and within the air operators, the Romanian Civil Aviation Authority will not request EASA and the European Commission derogation from the previously mentioned provisions, following that the date of application in case of this type of operations will remain 28.10.2014.
In this regard, taking into account the general principles regarding the transition to the new regulations for flight operations mentioned in "Information note - Transitional periods stemming from Regulation (EU) No 965/2012 on air operations" of 03.03.2014, we ask you to send us, until 30.05.2014, your point of view on the date of application of the provisions of paragraphs 4 and 5 (b) of Article 10 of Regulation (EU) no. 965/2012, introduced by Article 1, par. 7 of Regulation (EU) no. 379/2014.
