On 29.01.2014, Regulation (EU) no. 83/2014 of the Commission amending Regulation (EU) no. Amending Regulation (EC) No 965/2012 laying down technical requirements and administrative procedures in respect of air operations under Regulation (EC) No Regulation (EC) No 216/2008 of the European Parliament and of the Council introducing the FTL Subpart - Flight and duty time limitations and rest period requirements. It will enter into force on 18.02.2014 and will be applicable starting with 18.02.2016.
According to the provisions of Article 2 of Regulation (EU) no. 83/2014 of the Commission, Member States may choose not to apply the provisions of point ORO.FTL.205 (e) of Annex III to Regulation (EU) No 182/2011. 965/2012 and continue to apply the existing national provisions on in-flight rest until 17 February 2017.
In this regard, taking into account the general principles regarding the transition to the new regulations for flight operations mentioned in "Commission staff working paper - Transitional period stemming from the Proposal on Air Operations / Commercial Air Transport" of 29.05.2012, Romanian air operators operating operations of commercial air transport and / or general aviation may submit until 01.04.2014 the point of view regarding the date of application of the provisions of ORO.FTL.205 letter (e).
