COMPETENT AUTHORITY / QUALIFIED ENTITIES
Considering the provisions of art. 6, para. (1) of the Air Code, March 2020 edition, the competent authority is designated the Romanian Civil Aeronautical Authority (RoCAA)
Based on the provisions of art. 6, paragraph (1) and (3) of the Air Code, March 2020 edition and related RoCAA procedures, the certification authority's powers, provided in the RACR - LPAN ULM and RACR - CCO ULM regulations, are exercised by the Aeroclubul Romaniei (AR).
The activity of the above-mentioned qualified entity is carried out under the oversight, control and responsibility of RoCAA.

LEGAL CONDITIONS FOR CARRYING OUT FLIGHT ACTIVITIES WITH MOTORIZED ULTRALIGHT AIRCRAFT (ULM)
 
For the purpose of planning and carrying out flight activities in the national airspace, a motorized ultralight aircraft must have:
a. a registration certificate issued by the competent authority in accordance with the provisions of Annex 7 to the Convention on International Civil Aviation (ICAO);
b. a flight authorization (in the case of performing aerial work operations);
c. an insurance policy for damages caused to third parties within the validity period;
d. a flight authorization obtained in accordance with the provisions of HG no. 85/2021 (the commissioned pilot submitted a flight plan or sent a VFR notification to the RoCAA),
and its pilot must hold a license for motorized ultralight aircraft, within the validity period.
 
The license for motorized ultralight aircraft can be obtained by any person who is at least 16 years old and gives the holder the right to exercise the position of pilot-in-command and maintenance and repair technical staff of any ULM aircraft registered in Romania, within the limits of qualifications and the authorizations held (more information on this subject is available here).
 
Motorized ultralight aircraft registered in Romania can perform:
1. self-interested, private and school flights, as these activities are defined in art. 55 of the Air Code;
2. aerial work operations, as these activities are defined in art. 56 of the Air Code;

Ultralight aircraft registered in other countries can fly in the national airspace under the conditions:
1. a registration certificate issued by a competent authority in accordance with ICAO Annex 7;
2. an airworthiness document issued by the state of registration of the aircraft and recognized by the competent authority in Romania;
3. an insurance policy for damages caused to third parties within the validity period;
4. a flight authorization obtained in accordance with the provisions of HG no. 85/2021 (a flight plan was submitted or a VFR notification was sent to RoCAA).
The pilot of the aircraft in question must hold an ultralight aircraft pilot's license or another national license recognized by the competent authority. Before planning and carrying out flight activities in the national airspace, the owners of these aircraft will submit the licenses and airworthiness documents to the Aeroclubul Romaniei for the purpose of recognition.
 
In the national airspace, ultralight aircraft registered in another state can only carry out flights in their own interest and private flights, as these activities are defined in art. 55 of the Air Code, respecting all limitations and restrictions imposed by the airworthiness document issued by the competent authority of the state of registration.
 
 
In order to be valid on the territory of Romania, insurance policies held by aircraft operators registered in Romania or in third countries must be issued by one of the insurers or intermediaries mentioned in the list published by the Financial Oversight Authority (ASF) on its website.
In accordance with Art. 1, para. (1) from HG no. 583/2007, the holders/owners of aircraft registered in Romania have the obligation to send to RoCAA copies of the insurance documents in force. Copies of the documents are sent to the following e-mail address: contact@caa.ro, with the note "Attention of the National Certification Service / Airworthiness Directorate"
